Cannabis vs Hemp, What is the difference?

Simply put, hemp is cannabis. They are the same exact plant with only one key difference, the concentration of delta 9 THC. Delta 9 THC is what most people refer to when they say the word THC. Delta 9 THC is also the only cannabinoid that is listed as a scheduled substance by the DEA leading the states to create legislation in regards to the production, manufacture and use of products which contain delta 9 THC.

The federal government on the other hand has recognized the importance of hemp for use in manufacturing as well as due to its concentration of other cannabinoids that are not as highly regulated, such as CBD, and Delta 8 THC, among many others.

The federal government has determined that any cannabis plant that contains 0.3% or less delta 9 THC is to be considered hemp and is therefore exempt from the laws governing cannabis with higher concentrations. To further elaborate, there have been lawsuits filed against business owners who extract delta 9 THC from hemp, and use it to manufacture other items such as edibles and vape cartridges. The findings of these lawsuits determined that the language in the hemp farming act of 2018 is able to be applied more broadly than previously thought and is able to include any product that was manufactured using cannabinoids obtained from hemp. This means that our edibles can contain up to 0.3% delta 9 THC based on the dry weight of the finished product. These products have absolutely no difference between them and products containing delta 9 THC that was extracted from cannabis plants containing over 0.3% delta 9 THC, other than their legal status on the federal level.

The minor cannabinoids like delta 8 are not regulated in the same way. While laws differ for these cannabinoids on a state by state basis, federally we can create products with unlimited amounts of delta 8, HHC, THC-O, THCP etc as long as the finished product contains no more than 0.3% delta 9 THC and those minor cannabinoids were extracted from plants that would be considered hemp.
